This is an action brought by the defendants in error against the plaintiff in error to recover usurious interest paid. Hereinafter the parties will be designated as they were in the trial' court.

The first paragraph of the petition in this case alleges and states:

“First. That the plaintiffs are and have been at all times in this petition set out residents of Jackson county, Okla., and the defendant is and has been at all times mentioned in this petition a resident of Oklahoma county, Okla., and that this action is to recover a forfeiture and penalty imposed by statute, and…
