ADELE HEDGES, Justice.

Baylor College of Medicine (Baylor) brings this accelerated appeal contesting the trial court’s denial of its motion for summary judgment. We dismiss the appeal for lack of jurisdiction.

FACTS

The underlying suit for personal injury arose out of alleged medical malpractice. On July 16, 1998, John Tate Jr. (Tate) received treatment at Ben Taub Hospital (Ben Taub) for a broken ankle.
