*720 MEMORANDUM OPINION AND ORDER

WOLSKI, Judge.

In this case a contract which, by law, can only be performed by a nonprofit agency unless a purchase exception is granted, was awarded to such a nonprofit agency. The incumbent for-profit contractor initially protested the award, before seeing the administrative record, on the basis that allegedly-applicable regulations were violated. See Compl. ¶¶ 15-17.
