MEMORANDUM OPINION AND ORDER
Eugene Bigbie and several fellow employees have sued their union, Local 142, International Brotherhood of Teamsters (“Union”), and their employer, Artim Transportation System, Inc. (“Artim”). Complaint Count I, asserted under Labor Management Relations Act § 301 (“Section 301,” 29 U.S.C. § 185), claims (1) a breach by Artim of its collective bargaining agreement with Union and (2) a breach by Union of its duty of fair representation.
