Lion Oil Company and Monsanto Chemical Company v. National Labor Relations Board

When this case originally appeared in this court we held in 221 F.2d 231 that the strike involved was in violation of § 8(d) of the National Labor Relations Act, 29 U.S.C.A. § 158(d) and that the strikers lost their status as employees of the company and were not entitled to the relief provided in the Board’s order. The Supreme Court reversed in N. L. R. B. v. Lion Oil Co. & Monsanto Chemical Co., 1957, 352 U.S. 282, 77 S.Ct. 330, 1 L.Ed. 2d 331, and the case is back here for further proceedings in conformity with the opinion of the Supreme Court.
