OPINION
STANLEY S. HARRIS, District Judge.
Before the Court are plaintiffs motion for partial summary judgment and defendants’ motion for summary judgment, the parties’ respective oppositions and replies thereto, and the parties’ supplemental memoranda on defendants’ legal status. Upon consideration of the entire record, the Court grants defendants’ motion. “Findings of fact and conclusions of law are unnecessary on decisions of motions under Rule 12 or 56 .... ” Fed.R.Civ.P. 52(a); Summers v.
