Appellee SHed appellant in justice’s court, to recover $150 damages for the alleged negligent killing of a mare belonging to appellee, and recovered a judgment for said amount. An appeal having been taken to the county court, the trial in said court resulted in a verdict and judgment in favor of appellee for $150. No written pleadings were filed.

By the first assignment of error complaint is made of the admission of the testimony of the witness McFadden, to the effect that he had several animals killed by the train near the place where appellee’s mare was killed, and where the track was not…
