This was an action by W. R. Muhlhausen to recover damages for personal injuries sustained by the collision of his motorcycle with J. B. Klein’s automobile by reason of the negligence of J, B. Klein.

The plaintiffs theory of the collision, as pleaded and testified to by him, may be briefly stated as follows: Reno avenue is one of the streets of Oklahoma City extending east and west with a street ear line constructed in the middle of the street.
