Section A.—Appellee’s counsel agree to the statement of the case as made by appellant and make no objections to his statements of the evidence. The following is from the brief of counsel for the appellant, viz.:

“This suit was instituted by J. C. Rowland, the appellee, against appellant, the Gulf, Colorado & Santa Fe Railway Company, on January 20,1887, to recover for injuries alleged to have been sustained by appellee while attempting to alight from one of defendant’s cars.
