Smith, bis guardian, claiming to own in equal parts tfre lands hereinafter described, brought action in district court of Creek county to cancel a certain tax deed held by defendant covering about 15 acres of land, to quiet plaintiffs’ title, and to enjoin defendants from making further claim thereto, and for accounting for rents and profits.
