Lahtinen, J.(1) Appeal from an order of the Supreme Court (Connolly, J.), entered December 29, 2008 in Albany County, which, among other things, denied plaintiffs motion to preclude defendant’s testimony, and (2) cross appeals from a judgment of said court, entered January 12, 2009 in Albany County, among other things, granting plaintiff a divorce and ordering equitable *1410distribution of the parties’ marital property, upon a decision of the court.
