This action arises from a dispute over whether an Order entered by the United States Bankruptcy Court for the Northern District of Illinois (the “Order”) releases Oaktree Capital Management, L.P. (“Oak-tree”) and Hotel 71 Mezz Lender LLC (“Hotel 71 Lender”) (collectively, “Plaintiffs”) from withdrawal liability incurred under the Employee Retirement Income Security Act of 1974 (“ERISA”), 29 U.S.C. § 1001 et seq. and owed to The National Retirement Fund (the “NRF” or “Defendant”) and its Board of Trustees (“Trustees”).
