This is a bill in equity brought to reform a liability insurance policy in aid of an action at law pending in the superior court in which the complainant and respondent here are respectively plaintiff and defendant. After hearing on bill, answer and proof, the trial justice gave decision in favor of the complainant and a decree was entered granting the relief prayed for. The respondent appealed from this decree and has duly prosecuted its appeal to this court.
