Appeal by the relator, David Pumpyanslcy, from an order of the Supreme Court; made at the New York Special Term and entered in the office of the clerk of the county of New York on the 15th day of April, 1901, denying the relator’s motion for a peremptory writ of mandamus.

Hatch, J. :

This is an application for a writ of peremptory mandamus directed to the defendant as commissioner of highways of the city of New York, commanding him to remove or cause to be removed from the street or sidewalk of the southerly side of West Twenty-third street, west of its intersection with the westerly side of Sixth avenue, a stand or booth used and maintained for the purpose of vending newspapers and periodicals.
