This matter is before the court on two motions for summary judgment, one filed on behalf of defendants Tomkins Industries, Clements, Fischer, Carey, and Merwarth (the “Company defendants”), and the other filed on behalf of defendants Sheet Metal Workers’ International Association Local No. 2 and Mike Krasovec (the “Union defendants”).
