BACKGROUND

In May 1992, a fire damaged Zandra Perkins’s home in Murray, Utah (the Murray fire). After notifying her insurer, Bear River Mutual Insurance Co. (Bear River), and after meeting with a claims adjuster, Perkins hired First General Services, Inc. (First General) to perform the repair and reconstruc tion work. First General, in turn, subcontracted with Kent Frampton, dba Frampton Heating and Air Conditioning (Frampton), to install a swamp cooler in Perkins’s home.
