MASSEY, Chief Justice.
Suit from which the appeal is taken was initiated by Alton M. Toombs and others against Continental Bus System, Inc., the B. F. Goodrich Company, and others. Predicate for the suit lay in a serious collision between a bus operated by the Continental Bus System, Inc., and the automobile of Mr. Toombs. The collision occurred at about 7:50 p. m. on the 16th day of August in 1957, on Texas State Highway 114, about two miles east of Rhome, which is in Wise County, Texas.
