This action was commenced in the district court of Tulsa county by W. D. McCoy, in which he seeks an accounting and damages for breach of contract with the Braden Company for the sale of certain real estate in Tulsa county.

There is a motion to dismiss filed herein, which was overruled on the 23rd day of April, 1935. Under the rule of Lillard v. Meisberger, 113 Okla. 228, 240 P. 1067, the same may be renewed in the brief on the merits if permission of the court is obtained. Such permission was obtained in this case.
