Defendants Herbert F. Darling and Herbert F. Darling, Jr., doing business as Herbert F. Darling move to set aside a verdict of $500,000 against them on the ground that it is excessive, contrary to the weight of evidence and contrary to law on various grounds.

On January 4,1960, plaintiff was employed by Johnson, Drake & Piper, Inc., and was operating a backhoe while digging some ditches across the General Mills property in Buffalo, New York.
