In a negligence action to recover damages for personal injuries, etc., defendant appeals from a judgment of the Supreme Court, Nassau County, dated May 6, 1975, which is in favor of plaintiffs and against him, upon a jury verdict. Judgment reversed, on the law and the facts, and new trial granted with respect to the issue of damages only, with costs to abide the event, unless, within 20 days after entry of the order to be made hereon, plaintiffs Peter Senko and Loretta Senko shall serve and file in the office of the clerk of the trial court written stipulations consenting to reduce the…
