OPINION

BLISS, Presiding Judge:

Appellant, Nathaniel Smith, Jr., hereinafter referred to as defendant, was charged, tried and convicted in the District Court of Kay County, Oklahoma, for the offense of Larceny of Domestic Animals. His punishment was fixed at three (3) years imprisonment in the State Penitentiary. A motion for new trial was duly presented and overruled; and judgment and sentence was imposed on May 27, 1970.
