OPINION

BRETT, Judge:

Appellant, Dewey P. Shockey, hereinafter referred to as defendant, was charged, tried and convicted in the District Court, Choctaw County, Case No. CRF-73-1S, of the crime of Larceny of Domestic Animals in violation of 21 O.S.1971, § 1716. He was sentenced to serve a term of ten (10) years imprisonment in the state penitentiary in accordance with the verdict of the jury and a timely appeal has been perfected to this Court.

At the defendant’s trial Melvin Houchen testified that it was his duty to care for certain cattle belonging to his son-in-law, Raymond Forbus. He…
