This complex litigation arises out of the construction of a 785,000 square-foot vertical campus for Baruch College (“Baruch”), part of the City University of New York (“CUNY”), between about 1998 and about 2002 (the “Project”). 1 Plaintiff Travelers Casualty & Surety Company (“Travelers”), equitably subrogated to the rights of a prime contractor for the Project, third-party defendant Trataros Construction Inc.
