Defendant in error, Mrs. Annie E. Mc-Lain, instituted this suit in the district court of Dallas county against plaintiff in .error, Missouri-Kansas-Texas Railroad Company, to recover damages for the death of her husband. The parties will be designated as in the trial court.'
Charles M. McLain, husband of plaintiff, was killed about 6 o’clock a. m., Jan*207uary 11, 1931. Just prior to his death, he had been working as a watchman and was returning from his place of work to his home in the city of Dallas, walking southerly along Greenville avenue.
