This suit was filed in the District Court of Wilson County, Texas, by Walter Tips against Russell Oil Company and Phoenix Refining Company to recover damages for personal injuries and injuries to an automobile. Tips’ petition in the district court alleged that such damages were caused by the negligence of each and both of the defendants.
