From Baker: James A. Fee, Judge. Appeal by defendants from a judgment of the Circuit Court for Baker County in favor of plaintiff in an action brought to enforce defendant’s liability on bond of the city treasurer, for money alleged to have been misappropriated by him.

This is an action to recover upon the official bond of the defendant S. F. Murphy as treasurer of Baker City. The defendants J. H. Parker and Henry Rust are his sureties upon the bond. Murphy was duly elected treasurer at the regular annual election of the city November 7, 1892; and, having filed his oath of office, he executed and filed the bond in question on the 25th day of April, 1893, the condition of which is that the said S. F. Murphy “shall honestly and faithfully discharge his duties as treasurer of Baker City during his continuance in such office.”…
