Pagliarulo v. Bridgeport Machines, Inc.

Connecticut Appellate Court

Decided October 24, 1989No. 7643PublishedCited by 2 opinions

1Opinion of the CourtLavery, J.

The defendants appeal from the decision of the compensation review division of the workers’ compensation commission upholding the hearing commissioner’s decision in favor of the plaintiff. On appeal, the sole dispositive issue is whether the hearing commissioner and the review commission applied the correct standard in reviewing the suspension of workers’ compensation benefits under General Statutes § 31-2941 by considering the reasonableness of the plaintiff’s refusal of medical treatment rather than the reasonableness of the treatment itself. We find error.
