1Opinion of the Court

BAZELON, Chief Judge:

Appellant, a licensed physician registered under the Controlled Substances Act, 1 was convicted of 22 counts of knowing and unlawful distribution and dispensation of methadone under 21 U.S.C. § 841(a)(1) (1970). Finding § 841 inapplicable to appellant be cause of his status as a registrant, we reversed the conviction. 2 This judgment was in turn reversed by the Supreme Court, which held that registered physicians can be prosecuted under § 841 when their activities fall outside the usual course of professional practice. 3
