MEMORANDUM OPINION AND ORDER
McKINLEY, District Judge.
This matter is before the Court upon the Defendant’s motion for summary judgment [DN 12]. The matter has been fully, briefed and is ripe for a. decision.
SUMMARY JUDGMENT STANDARD
