FOSTER, Circuit Judge.

This is an appeal from a judgment dismissing a hill seeking an injunction to prevent the superintendent of police o-f New Orleans from repeatedly arresting plaintiff in error, plaintiff below, for alleged violations of a state statute which prohibits the use of slot machines as gambling devices. The parties will be referred to as they appeared in the District Court.
