This action came before the court on cross motions for summary judgment. After hearing the motions were taken under submission. This order disposes of the motions and the case.

In 1979, the Environmental Protection Agency (“EPA”) awarded the Sacramento Regional County Sanitation District (“District”) a grant under Title II of the Clean Water Act, 33 U.S.C. §§ 1281-1299, for the construction of a solids processing and disposal facility at the District’s regional wastewater treatment plant.
