Petitioner Ron Rinaldi, as administrator of the Uninsured Employers Fund (hereafter Fund), seeks review of an order of the Workers’ Compensation Appeals Board (hereafter Board). The Board affirmed the finding of the workers’ compensation judge (hereafter WCJ) that the injured worker, respondent Nicholai Zagainoff, was an employee of respondent Craig Butler, an unlicensed subcontractor uninsured for workers’ compensation liability, and not an employee of respondent Mike Smyth, the licensed but uninsured contractor who hired Butler.
