Proceeding pursuant to CPLR article 78 (trans*1132ferred to this Court by order of the Supreme Court, entered in Rensselaer County) to review a determination of respondent Board of Education of the Hoosick Falls Central School District which terminated petitioner’s employment.

Petitioner, a custodian for many years at respondent Hoosick Falls Central School District, was involved in an apparent domestic incident in February 2010 with his girlfriend.
