Paine, the present plaintiff, on the 7th of July, 1875, brought an action of assumpsit against the Gorman Insurance Company, and factorized Lester, the present defendant, as agent and debtor of the company. The insurance company was a corporation organized under the laws of the state of Pennsylvania, and located in that state. The company appeared in the action and made defense and judgment was rendered against it.
