The appellee, who was an assistant fire marshal in Philadelphia, claims that as such he was a “policeman and fireman” within the meaning of the second paragraph of section 18 of Article XIX of the Charter Act of June 25, 1919, P. L. 581 (53 P.S., sec. 3338). As such he would not be subject to removal except for just cause, upon written charges, and after an opportunity to be heard in his own defense.
