On April 13, 1940, the defendant in error, hereinafter referred to as plaintiff, instituted this action against the plaintiff in error, hereinafter referred to as defendant, to obtain a divorce, custody of two minor children, money judgment for their support, attorney fees, division of property and to restrain the defendant from disposing of any of the property during the pendency of the litigation. The ground alleged for divorce was extreme cruelty. On the same day the. petition was filed the court made an ex parte order which restrained the defendant from disposing of said property and…
