Appeal from an order denying plaintiff’s motion for amended findings or for a new trial.
On August 16, 1940, plaintiff, a municipal corporation, by its village council, entered into an agreement in writing with defendant, whereby the latter agreed to construct for the former an electric power plant and distribution system according to plans and specifications on file with the village clerk.
