DAVIS, Circuit Judge.

This is an appeal from a decree dismissing a petition for a rule upon the United States to show cause why the decree of June 9. 1921, condemning lands in Bucks county, Pa., should not he set aside.

On January 7, 1919, the United States, by Newton D.
