NORDBYE, District Judge.
This action is based upon the theory of libel. Plaintiff, whose true name is Bernard Clare, is employed by a newspaper in the City of Minneapolis, and writes items for that paper. He has followed that occupation at various locations including Minneapolis and Duluth, Minnesota, Detroit, Michigan, Milwaukee and Superior, Wisconsin, and Iowa Falls, Iowa, since 1917. His writing has extended into the newspaper, magazine, and periodical field, particularly in the states of Minnesota, Wisconsin and Michigan.
