OPINION

OGLE, Judge.

The petitioner, Jennifer Kelly, appeals the denial by the Madison County Circuit Court of her petition for habeas corpus relief on April 27, 1999. Specifically, the petitioner challenges the execution of a five day sentence of incarceration more than four years after her conviction of driving under the influence in violation of TenmCode Ann. § 55-1CM01 (1993). She asserts both that her sentence has expired and that requiring service of her sentence at this time would violate principles of due process contained in the Tennessee and *343United States constitutions.
