I. INTRODUCTION

Plaintiffs Joseph Canino (“plaintiff’) and his wife Julia Canino commenced this ac tion for injuries allegedly incurred when plaintiff received a shipment of sixty monkeys in the course of his employment as a lab technician and subsequently contracted a disease known as Herpes B Simian Virus (“HBSV”).
