FLANNERY, District Judge.
In this matter, the court is again called upon to decide challenges to regulations implementing the Surface Mining Control and Reclamation Act of 1977 (“SMCRA” or “the Act”), 30 U.S.C.A. 1201 et seq. The Act seeks to protect society and the environment from the harmful effects of surface coal mining, sometimes known as “strip mining,” as well as from surface damage caused by underground coal mining.
