FINDINGS OF FACT

The plaintiff in this case, Phillip S. Wood-ruff,1 is a retired employee of the Federal Aviation Administration (FAA). On September 29, 1995, the plaintiff contends that he slipped and fell at his workplace and sustained injuries which aggravated pre-existing conditions and caused him to miss work from September 29, 1995 to October 3, 1995. Plaintiff underwent surgery on May 1, 1997, *808which plaintiff claims was necessary because of the September 29,1995 accident.
