(after stating the facts). — The petition in this case is in the nature of a bill in equity and the *691relief 'Sought is an order on the defendant corporation and its officers, to transfer ten hundred and eighty shares of stock to the plaintiff on the books of the company and issue to him a certificate for the shares. Prior to their alleged purchase by the plaintiff, these shares stood on the books in the name of U. Gf. Biby, and he held a certificate for them; but they were actually owned by A. L.
