OPINION

HYDER, Judge.

This is an appeal in the nature of a writ of error from a conviction of transporting more than one gallon of unstamped whiskey and a resulting sentence of two years in the penitentiary.

Haskle Thurman was arrested on the morning of October 29, 1968, by two Chattanooga City Detectives and an Agent of the State Alcohol Beverage Control Commission.
