PIVARNIK, Justice.

This is an appeal from the trial court's refusal to order payment of a balance of pauper attorney's fees incurred in the defense of a capital murder death penalty case. Appellants are court appointed counsel who represented James Lowery in cause No. CCRV 882-92 in the Hendricks Circuit Court. The cause originated in the Tippecanoe County Superior Court. Change of venue was perfected to Boone Superior Court and in January, 1980, Appellant Lawrence Giddings was appointed as counsel for Lowery in that court.
