Gordon, J.

The appellant was for four years prior to January, 1895, the qualified'and acting treasurer of Pierce county, and the respondent Hedges succeeded him as such treasurer. The respondents Holmes, Rogers and Bartholomew constitute-the board of commissioners, and the respondent Gloyd is county auditor of said county. From the record it appears that during the terms of office as such treasurer the appellant deposited sums of money coming into his hands as such treasurer in various banks, some of which banks thereafter failed, and this proceeding…
