APPEAL from the Circuit Court for Dane County. This action is upon the official bond of the defendant Edward O. McFetridge, as state treasurer, during the term commencing on the first Monday in January, 1885, and ending on the first Monday in January, 1887, to which office he was duly elected at the general election in November, 1884. It is brought against him and all the surviving sureties in such bond, eleven in number.

This case, and that of State v. Harshaw, post, p. 532, which involves substantially the same legal questions, were argued together in this court. It is proper and just to say at the outset that the arguments contain abundant evidence of the great labor and research bestowed upon the cases by the able counsel of the respective parties to the controversy.
