This suit was instituted on December 1, 1934, in the district court of Hutchinson County, by the defendant in error, L. B. Cox, against Ralph McNutt and wife, Mabel, to recover the amount alleged to be due on a promissory note executed on January 31, 1930, by Ralph McNutt, payable to the order of the First National Bank of Borger, Texas.
