In Error to the District Court of the United States for the Eastern District of Oklahoma; Ralph E. Campbell, Judge. Action by the United States against the Kansas City Southern Railway Company for violation of the Hours of Service Daw. Judgment for defendant, and plaintiff brings error.

VAN VALKENBURGH, District Judge.

This suit was brought against the Kansas City Southern Railway Company to recover penalties for violation of the act of Congress of March 4, 1907, known as the “Hours of Service Daw.” Chapter 2939, 34 Stat. 1415, 1416 (U. S. Comp. St. Supp. 1911, pp. 1321, 1322). The complaint is in five counts, in each of which the maximum penalty of $500 is prayed. In these several counts it is charged that five employes of defendant, a conductor, engineer, fireman, and two trainmen, were required and permitted to remain on duty for a period of 17 hours and 5 minutes, or 1…
